Q: I'm a survivor of a retiree, not a retiree. Are my benefits protected like retirees' benefits in the bankruptcy?
A: Yes, as a survivor of a retiree your benefits are protected by Section 1114 of the bankruptcy Code, the same as a retiree.
Q: Should I sign up for health benefits in the open enrollment period?
A: Yes. The Section 1114 Committee is working to negotiate improvements to the 2006 health benefits, or have the bankruptcy judge restore cut benefits, prior to January 1, 2006, when the changes would otherwise become effective. We hope to reach agreement with Delta shortly or have the Bankruptcy Judge decide the issues at a hearing on December 19, 2005. In the meantime, however, you should sign up for health benefits in the open enrollment period.
Q: Does it do any good to sign up for health benefits since Delta is in bankruptcy?
A: Yes, Delta has permission to continue to pay health benefits from the Bankruptcy Court, and will still be providing health benefits during the bankruptcy, so you should sign up for health benefits in the open enrollment period.
Q: I have a question about my benefits. Who do I contact?
A: For questions about your benefits, call 1-800-MYDELTA.
Q: I am a survivor. Will the bankruptcy affect my survivor income benefits?
A: For now, no. The Delta Family Care Disability and Survivor Plan is funded by a separate Disability and Survivor Trust. The money in that Trust is not property of Delta or its bankruptcy estate, and is not subject to the claims of Delta's other creditors.
Q: One of my medications is now going to be in Tier 4. Does that mean I have to pay for all my prescriptions at Tier 4 prices?
A: No. Only those medications that are listed in Tier 4 must be paid for at Tier 4 co-pay prices. All other medications will be paid for at the co-pay price of the tier in which they are categorized.
Q: I do not have a computer and want to sign up for my benefits enrollment but need some help. Is there anyone to assist me in completing the enrollment process?
A: Currently computers are being provided in a room set up at the General Offices in the Admin #2 building, room 409 (Atlanta) and there are retirees that have been gracious enough to donate their time to assist anyone that may need help in completing their enrollment process. The offices are open from 8am to 5pm EST until through December 08, 2005.
Q: Is there a chance that we will get to return to the benefits cost and options we had in 2005?
A: Unfortunately, that will not be possible. As you know, Delta is in bankruptcy and active, retired and survivors will all share in the sacrifice as Delta works to reduce cost to exit bankruptcy and compete with its rivals. That is why it is extremely important to protect our benefits from deep early cuts, to make sure that all parties in the bankruptcy participate fairly in the sacrifice.
Q: Someone told me there was an 800 number I could call to give my comments about issues you are asking us to comment on. I have a computer but it would be much easier to just call the 800 number to pass along my comments, is that OK?
A: No. The 800 number is intended only for those that do not have a computer, not for those that have computer access. As you can imagine, it is much more labor intensive to use the 800 number and we all need to do our part to try and hold down the cost of legal fees in this process. Using the phone line for its intended purpose will help greatly.
Q: I do not have a computer, so how can I contact you and participate in any surveys you might have without a computer?
A: We are currently working to secure a process that will allow those without computer access the ability to participate in the survey by phone to an 800 number.
Q: Can the 1114 committee also help with regard to my pension benefits?
A:No. The 1114 Committee's scope does not include the pension plan. Information pertaining to the security of your pension and the steps currently being taken to protect it can be found on the DALRC website www.dalrc.org . Please continue to monitor the DALRC website for any future information regarding your pension.
Q: I know that it is expensive to have lawyers help to protect our benefits, who pays for them?
A: Once the 1114 Committee was appointed by the judge, the committee hired legal counsel (the same counsel who previously advised the DALRC in preparing for a Delta bankruptcy) to represent retirees and survivors with regard to their health and welfare benefits including insurance and disability benefits. Farella Braun and Martel (general counsel, bankruptcy counsel, and benefits counsel), Townsend Townsend and Crew (litigation assistance) and Foley and Lardner (local counsel in New York) will ask the court to approve their appointment on December 19, 2005.
Q: What do you do with the information you request on the website? I send in my comments as requested and don't hear back from you.
A: We appreciate very much your participation in our surveys, and we use the information you provide to us to help determine the Committee's priorities. However, it is impossible to respond to most of the information provided. As you know, we are all volunteers and with the receipt of hundreds, sometimes thousands of retiree comments in these surveys, it is just not possible to reply to everyone.
