Retiree / Survivor Unsecured Claims Notices Mailed Jan. 26 1/29/07
On Jan.25, 2007, Delta began mailing packages to retirees and survivors that describe the amount of unsecured claims they may have through Delta’s bankruptcy process and other information relevant to such claims. The claims are part of Delta’s agreements with the pilot and ground/flight attendant retiree committees established by the Bankruptcy Court in connection with changes to Delta’s retiree health care coverage.
These packages also include information on claims agreed to as part of the settlement agreements with DP3, a retired pilots group, in connection with the termination of non-qualified pension benefits for retired pilots. Not all retirees and survivors will get the same package of information since their eligibility for claims may differ based on individual circumstances (e.g., pilot or non-pilot; eligible for health care benefit claims, nonqualified pension claims, or both).
- The package includes information about how claims have been determined. Recipients should closely read the information in the package since it contains a discussion of legal rights they may have and other important information. However, no action is required by the retirees and survivors in connection with the claims outlined in the packages.
- The claims information does not apply to active employees.
- Each retiree or survivor with a claim will have the opportunity to vote with respect to the Plan of Reorganization.
- The claims will be paid in connection with a Plan of Reorganization once a plan is approved by the Bankruptcy Court.
Those interested in finding out more can go to www.deltadocket.com to review the applicable Term Sheets, Settlement Agreements, Delta’s Plan of Reorganization, associated disclosure statements, as well as other disclosure documents filed Dec. 19, 2006 with the Bankruptcy Court. Information relevant to retirees is also on the Retiree Connection web site at http://www.dlretiree.info/.
Questions & Answers:
Retiree / Survivor Unsecured Claims Notices Mailed Jan. 26 Q&A 1/29/07
Why do some pilot retirees have claims for non-qualified pension benefits?
The non-qualified pension plans were terminated during the bankruptcy and payments from those plans stopped. The claims for the non-qualified pension benefits are part of two settlement agreements approved by the Bankruptcy Court.
Why do some retirees and survivors have claims as part of health benefit changes?
In October the Bankruptcy Court approved changes to retiree healthcare benefits for Delta retired pilots and survivors as well as Delta retired ground and flight attendant employees and survivors. The changes were part of agreements between Delta and pilot and ground/flight attendant retiree committees established by the Bankruptcy Court which contemplate claims for the affected retirees and survivors.
The retiree healthcare changes became effective Jan 1, 2007 and will deliver approximately $50 million in annual savings.
Who should recipients contact if they have questions about this unsecured claim package?
Recipients can call Delta’s claims agent, BSI, at 866-271-8942. These agents can assist with updates to any personal data corrections in the package, for example, date of birth or employee number.
Recipients will have a vote on Delta’s Plan of Reorganization. How will this process work?
Prior to the voting period, a ballot, instructions, and other related materials will be mailed to those who can vote.
Does this claim have any affect on my qualified pension benefit?
No. For nonpilots this claim is related to healthcare benefits not pension benefits. Delta will continue to pay qualified pension benefits from the Delta Retirement Plan. For pilots this claim is also related to healthcare benefits, but for some individuals may also be for nonqualifed pension benefits. If you are currently receiving a pension annuity payment, it is being paid from the Delta Pilots Retirement Plan (DPRP) which has been terminated and is now the responsibility of the Pension Benefit Guaranty Corporation (PBGC). Payments related to the DPRP will be paid by PBGC in the future and are not affected by the claim.
